1. Acceptance of Agreement

By accessing or using the Service, you agree to this Agreement. If you do not agree, please do not use the Service. We reserve the right to change or modify this Agreement at any time. Changes become effective upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Agreement.

2. Eligibility

By accepting this Agreement, you represent and warrant that: (i) you are at least 18 years of age or the legal age of majority where you reside; (ii) you have not previously been suspended or removed from the Service; (iii) your registration and use of the Service complies with all applicable laws and regulations; and (iv) you are physically located in the United States and within a jurisdiction in which we offer our Service.

The Platform and Service are available only for individuals aged 18 years or older. Our Service is subject to state regulations and may change from time to time.

3. Your Relationship With Us

Arrow Health is a technology company that makes available to registered members certain products and services offered by Arrow Health and/or affiliated practices, licensed clinicians, participating pharmacies, and CLIA-certified laboratories.

By accepting this Agreement, you acknowledge that Arrow Health is not a healthcare provider and that by using the Service, you are not entering into a doctor-patient relationship with Arrow Health. You may, however, be entering into a provider-patient relationship with one or more independent Providers through the platform.

Arrow Health is not responsible for delays, limitations, and failures which are the responsibility of the Providers or vendors. Arrow Health makes no representations or warranties about the suitability, reliability, timeliness, or accuracy of medical care provided by Providers.

4. Use of the Service

The Service may include access to telehealth consultations, healthcare resources, and other health-related information. You agree to provide accurate and complete information when using the Service and to update such information as necessary. Misrepresentation or falsification of information may result in suspension or termination of your account.

5. Appointment Scheduling and Cancellation Policy

You may schedule appointments with Providers through the Platform, subject to Provider availability.

Cancellation Policy: If you need to cancel or reschedule your appointment, you must do so at least 24 hours before your scheduled time. Cancellations made less than 24 hours in advance may result in a cancellation fee.

6. Membership Program

Arrow Health offers a subscription-based membership program that provides access to telehealth consultations and other health-related services. Membership fees are billed on a monthly or annual basis, depending on the plan you select. Details of membership benefits and pricing can be found on the Website.

7. Fee-Based Services

All members are responsible for fees related to clinical consultations, prescription medications, and laboratory services. You may elect to use insurance for covered services or self-pay directly through the Platform. You agree to pay all fees associated with the services you receive.

If you choose to use insurance, you authorize Arrow Health to submit claims on your behalf. You will be responsible for any amounts not covered by insurance, including co-pays, deductibles, and uncovered services.

8. Social Media

Arrow Health may provide features allowing interaction via social media platforms including Facebook, X, Instagram, TikTok, and LinkedIn. Your activities on these platforms are subject to each platform's respective terms and policies. Arrow Health is not responsible for any content you share on third-party platforms.

9. Telehealth Services and Consent

Telehealth allows healthcare providers to deliver services remotely through electronic communication. You acknowledge that there are both benefits and risks associated with telehealth. By using telehealth services, you consent to the use of electronic communication and agree to the Informed Consent for Telehealth provided to you via the Platform.

10. Privacy Policy

We are committed to protecting your privacy. Please review our Privacy Policy to understand how we collect, use, and disclose your personal information. Your use of the Service constitutes your consent to the practices described in the Privacy Policy.

11. Conduct Guidelines

When using the Platform, you agree to:

  • Not use another person's account or allow others to use your account
  • Not submit false or misleading information
  • Not record or distribute any telehealth or in-person sessions without the express consent of all parties
  • Not use the Platform for any illegal or unauthorized purposes

Violation of these guidelines may result in suspension or termination of your access to the Service.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Arrow Health and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from the Service will not exceed the amount paid by you for the use of the Service.

13. Dispute Resolution and Arbitration

You agree that any disputes arising out of or relating to this Agreement or the Service will be resolved by binding, individual arbitration. You waive your right to a jury trial and to participate in class actions. The arbitration will take place in New York, New York, and will be conducted under the rules of the American Arbitration Association (AAA).

14. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
